US LLC for Freelancers Working From Abroad

A US LLC for freelancers gives you a business name, a US address and an EIN that many clients and platforms expect. Here is when it helps, what it costs you in paperwork, and how to start.

What you get

QUICK ANSWER

Do freelancers need a US LLC?

No, freelancers do not need a US LLC to work for clients. It is optional. A US LLC for freelancers can help you look more established, separate business and personal money, and apply for US-linked payment tools. It also adds yearly paperwork, so weigh the benefits against the admin before you form one.

Most freelancers form a US LLC for three practical reasons: credibility, payments and separation. A company name and a US business address on your invoices can make a client feel more comfortable, especially larger US and European buyers who prefer to pay a company.

The second reason is access. Some payment tools and marketplaces ask for a business entity, a US address and an EIN. An LLC gives you all three. It does not guarantee any account, because Stripe, Wise, Payoneer and banks decide approvals on their own rules.

The third reason is separation. Keeping client income in a business account makes your records cleaner and your taxes easier to explain to an adviser.

If you have a handful of clients who already pay you by bank transfer or a marketplace, an LLC may add cost without much benefit. You will pay state fees, a yearly registered agent fee after year one, and you must keep filings current.

An LLC also does not remove your home-country tax duties. Your country may tax your worldwide income, and rules on foreign companies and foreign exchange differ widely. Speak to a qualified adviser at home before you form.

Many freelancers choose Wyoming because the formation filing fee is $100, the annual report minimum is $60, and Wyoming has no state personal income tax. Delaware is popular with people who plan to raise investment later, and it charges a $400 annual LLC tax due June 1. New Mexico has a $50 filing fee and no annual report for LLCs.

Pick the state that fits your plans, not the one a friend used. Our state comparison page lays the options side by side.

Once you have your EIN and company documents, you can apply for tools such as Wise Business or Payoneer, and some founders apply for a US bank account. Each provider reviews your business, your website or profile, and your documents. Requirements change, so read the current rules on each provider’s site.

Stripe does not support businesses based in Pakistan directly. Some founders apply through a US LLC with a US bank and address, but Stripe may still decline. Freelance marketplaces often have their own payout setups, so check them first.

What should I keep ready for applications?

Your Articles of Organization, EIN letter, operating agreement, passport, proof of address and a simple website or portfolio. A clear description of your services helps reviewers understand your business.

Can I use my LLC with Upwork or Fiverr?

Platform rules differ and change. Check each platform’s help pages about business accounts and tax forms, and ask a tax adviser how to complete them.

Formation is the start, not the finish. Plan for a yearly calendar: your state annual report or tax, the registered agent renewal, and the federal reporting a foreign-owned single-member LLC generally owes. Form 5472 with a pro forma Form 1120 is usually required even with no income if there are reportable transactions, and the penalty for missing it starts at $25,000.

Also check FinCEN’s site for current beneficial ownership reporting rules, since they have changed. FenFile’s Growth plan adds bank and payment-tool guidance and a compliance calendar on top of Starter formation, and our compliance support add-on can help later.

FAQ

Questions founders ask us

Can’t find your answer? Our team replies on WhatsApp and email.

Yes. Non-residents may own a US LLC, and no US visa or SSN is needed to form one. You do need a registered agent with a physical address in the formation state. Your home country may still tax your income, so confirm local rules with an adviser.

Your LLC needs a registered agent address in its state, which is included for the first year in FenFile plans. For a mailing address on invoices or applications, we offer a shared mailing address add-on through a partner.

Not automatically. Stripe does not support businesses based in Pakistan directly, and some founders apply through a US LLC with a US bank and address. Stripe makes the decision and may reject the application, so never rely on it.

It depends on your facts. A single-member LLC owned by a non-resident with no US-connected income generally owes no US federal income tax, but reporting is still required. Your home country rules also apply. Ask a qualified tax adviser.

Costs include the state filing fee, the FenFile plan and later renewals. State fees are extra and shown before you pay. Our pricing page lists plan details, and payment in PKR is possible through WhatsApp.

No. FenFile is a business-services company. We handle filings, documents and setup guidance, but we do not give legal or tax advice. Please speak to a qualified adviser for those questions.
