Do non-residents pay US taxes on LLC income? Often not at the federal level, but reporting duties and home-country tax still apply. This guide explains the general rules and where to get advice.
A single-member LLC owned by a non-resident with no US-connected income generally owes no US federal income tax. Reporting is still required, including Form 5472 in many cases, and home-country tax rules still apply. Rules depend on the facts, so speak to a qualified tax adviser.

The honest answer is it depends on where your income comes from and what your LLC does. FenFile is not a tax adviser, and this guide gives general information only. A qualified adviser should review your own facts.
In broad terms, a single-member LLC owned by a non-resident with no US-connected income generally owes no US federal income tax. That does not mean zero paperwork. It also does not mean zero tax at home.
By default, the IRS treats a single-member LLC as a disregarded entity. That means the LLC itself does not file a separate income tax return in the usual way. Its activity is treated as the owner’s.
For a foreign owner, this has a twist. A disregarded entity owned by a non-resident is still treated as a corporation for certain reporting rules. That is why Form 5472 and a pro forma Form 1120 may be required each year, even when there is no income.
The tax question turns on whether your income is connected to the United States. Working from outside the US, serving clients abroad and holding no US office, employees or inventory is very different from running a business with US operations.
Income tied to US activity can be taxed, and the rules involve concepts such as effectively connected income and US-source income. Examples that raise the question include a US warehouse, US employees, or a fixed place of business. Selling online to US customers while you work from abroad can still raise questions, so ask an adviser.
A foreign-owned single-member LLC generally must file Form 5472 with a pro forma Form 1120 each year if it has reportable transactions, even with no income. Reportable transactions include things such as owner capital contributions or loans. The penalty for failing to file starts at $25,000, which is why this form deserves attention.
There are also state filings, such as annual reports, and beneficial ownership reporting rules that have changed over time. Check fincen.gov for current requirements. Our guide on Form 5472 explains the form in detail.
A US LLC does not move your tax residency. If you live in Pakistan, your income may still be taxable there, and the rules for foreign-source or export income can differ. Pakistan has its own filing obligations, and treatment of income from an overseas company can be technical.
Please confirm your position with a Pakistani tax professional, and ideally one familiar with cross-border work. We do not give tax advice, and we will not tell you that the LLC removes tax duties.
Keep clean records from day one. Keep business money separate from personal money. Save invoices, contracts and bank statements. Put the Form 5472 and state deadlines on a calendar. Book a short call with a tax adviser before your first large payment, not after.
FenFile Growth includes a compliance calendar, and annual compliance support is an optional add-on. Neither replaces a tax professional.

Generally not, if the LLC has no US-connected income. Reporting is still required, and the rules depend on your facts. A qualified tax adviser should confirm your position before you rely on this.
Possibly yes. A US LLC does not change your tax residency, and Pakistan can tax income of residents under its own rules. Speak to a qualified Pakistani tax professional about your case.
Possibly. A foreign-owned single-member LLC generally files Form 5472 with a pro forma Form 1120 if it has reportable transactions, even with no income. State annual reports may apply too.
The penalty starts at $25,000 for failure to file when required. That is why founders should confirm their filing duties each year and keep reliable records.
Yes. A multi-member LLC is generally taxed as a partnership by default, with different forms and withholding rules. Ask an adviser how your ownership structure is treated.
An LLC is a legal structure, not a tax shelter. Tax outcomes depend on your income sources, residency and activity. Anyone promising you no tax duties without asking about your facts should be treated with caution.
