US LLC From India: A Practical Guide for Founders

A US LLC from India can serve overseas clients, but your home-country rules are a separate step. This guide covers the US side and what to ask a local adviser.

What you get

QUICK ANSWER

Can someone in India open a US LLC?

Generally yes. Non-residents may own a US LLC, and no US visa or SSN is needed to form one. A us llc from india still needs a registered agent in the formation state and an EIN from the IRS. Your own country’s rules on foreign companies, tax and money transfers are separate, so confirm them with a local adviser.

Founders and freelancers in India often serve clients abroad. A US LLC gives them a company name, a US address for legal mail and an EIN that platforms and clients can recognize. These are practical benefits, not guarantees of account approvals.

Founders in India often work in software, design, consulting and ecommerce. A US LLC can suit those who bill overseas customers or plan a US-facing brand.

The process is the same for most non-residents. Choose a state and name, appoint a registered agent, file the Articles of Organization, sign an operating agreement and apply for an EIN. With no SSN or ITIN, the EIN application goes by Form SS-4 using fax, mail or phone, and processing times vary.

FenFile prepares the filing, supports the EIN steps and keeps your documents together. You provide ID and address details.

Which state should I choose?

Wyoming has a $100 filing fee and a $60 minimum annual report. Delaware charges a $400 annual LLC tax due June 1. New Mexico has a $50 filing fee. Compare them against your plans.

Do I need to visit the US?

No visit is required to form a US LLC. Some banks and providers have their own identity checks, which you should read about before you apply.

Rules about overseas investment, foreign income reporting and remittances vary and change, and we do not state them as fact here. Before you form or fund a US company from India, speak to a chartered accountant or qualified adviser who handles cross-border structures.

Because we are not a law or tax firm, we cannot tell you your local obligations. Ask a qualified local adviser about registering foreign company interests, reporting foreign income, remitting funds and any licensing needs for your work.

After formation, many founders apply for Wise Business, Payoneer or a US bank account. Each provider reviews your business and decides approval, and requirements change. Stripe availability depends on where the business is based, and it may reject applications even when you have a US LLC.

FenFile’s Growth plan includes guidance for bank, Wise, Payoneer and Stripe setup, but we cannot promise approvals. Keep your paperwork consistent and your website or profile clear.

A US LLC needs ongoing care. Plan for the state annual report or tax, the registered agent renewal after year one and federal reporting. A foreign-owned single-member LLC generally files Form 5472 with a pro forma Form 1120 each year if it has reportable transactions, and the penalty for failing starts at $25,000.

Check fincen.gov for current beneficial ownership reporting rules, which have changed. Our Growth plan includes a compliance calendar and our annual compliance support add-on can help later.

FAQ

Questions founders ask us

Can’t find your answer? Our team replies on WhatsApp and email.

US law generally allows non-residents to own an LLC. Whether your home country has rules about owning foreign companies is a separate question. Ask a qualified local adviser before you form.

No. Non-residents can form a US LLC without a US visa or SSN. You need a registered agent with a physical address in the formation state. You can apply for an EIN using Form SS-4.

A non-resident without an SSN or ITIN cannot use the IRS online application. Apply with Form SS-4 by fax, mail or phone. The IRS publishes an international line, +1 267-941-1099. Processing times vary.

It depends. A single-member LLC owned by a non-resident with no US-connected income generally owes no US federal income tax, but reporting is required and your home country may tax you. Ask a qualified adviser.

Maybe. Banks, Stripe, Wise and Payoneer decide approvals themselves and requirements change. A US LLC can give you the documents they ask for, but there are no guarantees. We offer setup guidance.
